Av LegalFriend • Publicerad 16/03/2021Ett arvsavtal är ett avtal som arvslåtaren skrivit innan sin död och som handlar om dennes kvarlåtenskap. Huvudregeln är att sådana arvsavtal inte är giltiga. Det samma gäller en utfästelse om gåva, det vill säga att arvslåtaren lovat att någon ska få ärva något. Det är bara genom ett testamente som en arvlåtare kan bestämma över sitt arv eller vem som ska få vad genom en gåva. 17 kap. 3 § ÄB
Det krävs ett testamente
Det är bara om arvsavtalet eller utfästelsen om gåvan är utformad som ett testamente som innehållet blir giltigt. Du kan läsa mer om kraven på hur ett testamente ska utformas här. 17 kap. 3 § ÄB.
Ett avtal om ett arv eller testamente
Om två eller flera personer avtalar med varandra om hur ett ett arv eller testamente ska fördelas eller hanteras på något sätt. så är även sådana avtal ogiltiga. 17 kap. 1 § första stycket ÄB
