Om en dödsbodelägare begär det, ska rätten förordna att dödsboets egendom ska avträdas till förvaltning av en boutredningsman. Rätten utser då även någon att vara boutredningsman. I vissa fall kan även exempelvis legatarier eller borgenärer begära att ett sådant beslut fattas. Om någon genom testamente har blivit utsedd till testamentsexekutor, och således trätt i arvingars och universella testamentstagares ställe i fråga om dödsboets förvaltning, kan också denne begära att boets egendom avträds till förvaltning av boutredningsman. Vem som kan påkalla beslut om boutredningsman framgår av 19 kap. 1 § ÄB.
Boutredningsmannen ska som utgångspunkt företa alla för boutredningen erforderliga åtgärder. Delägarnas mening ska dock inhämtas, om det lämpligen kan ske, i fråga om rättshandlingar som i avsevärd mån inverkar på deras behållning i boet eller beträffande andra angelägenheter av vikt, 19 kap. 11 § ÄB. Boutredningsmannen får endast överlåta fast egendom om delägarna skriftligen samtyckt till detta eller, om så inte kan ske, rätten tillåtit det. Har rättshandling företagits i strid med delägarnas önskemål måste dödsbodelägarna, för att ogiltigförklara en sådan åtgärd, väcka klandertalan om detta i enlighet med 19 kap. 13 § ÄB. Boutredningsmannen företräder dödsboet mot tredje man och har rätt att tala och svara i mål som rör dödsboet, 19 kap. 12 § ÄB.
Förordnande att vara testamentsexekutor ska som utgångspunkt anses innefatta ett bemyndigande att företa alla för boutredningen erforderliga åtgärder, 19 kap. 20 § ÄB.
